These terms form an agreement between Little Orchard Publishing Ltd (company no. 15673990), trading as Sparklemuffin ("Sparklemuffin", "we", "us"), and you, the parent or guardian who holds the account. By creating an account you agree to them on behalf of your family.
1. Who can use Sparklemuffin
The account holder must be an adult (18 or over). Children use the service through accounts created and supervised by their parent or guardian. Parents must register an account before their child can use the platform.
2. Your responsibilities as the account holder
Keep your login details and your child's passcode safe. Review and approve what your child shares, and supervise their use. Make sure your child follows the community rules below.
3. Community rules (acceptable use)
To keep Sparklemuffin kind and safe, everyone agrees not to: be unkind, bully, or harass anyone; share anything inappropriate, hateful, frightening, or unsafe; share personal information such as real names, addresses, schools, or phone numbers; try to contact other members outside Sparklemuffin, or arrange to meet in person; or break the law or infringe others' rights, including copyright.
We may remove content and suspend accounts that break these rules.
4. Your content
Children keep ownership of what they create. By posting content on Sparklemuffin you grant us a limited licence to store, display, and transmit that content solely for the purpose of providing the service. This licence ends when the content or account is deleted.
5. Subscription & payment
Sparklemuffin is a paid subscription service, charged per child. Billing is handled by Stripe. A 14-day free trial is available on sign-up; no payment is taken until the trial ends. After the trial, your subscription renews automatically on an annual basis; we will notify you by email before renewal. You can cancel at any time from your dashboard. Because access to digital content begins immediately on purchase, you waive your right to cancel under the Consumer Contracts Regulations 2013 once the subscription period has begun, and no refund will be issued for the remaining period. This does not affect your statutory rights.
6. Safety & moderation
We moderate content and provide reporting tools. For full details, see our Safeguarding Policy. To the fullest extent permitted by law, Sparklemuffin is not liable for content posted by users. We are not responsible for any harm arising from your use of the service beyond what is required by applicable law.
7. Liability & changes
We provide Sparklemuffin with reasonable care and skill. To the fullest extent permitted by law, we exclude all other warranties. Our total liability to you in connection with these terms shall not exceed the amount you paid in the 12 months preceding the claim. Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
These terms are governed by the law of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. We may update these terms from time to time and will notify you by email of any material changes. Continued use after the effective date of a change constitutes acceptance.
